TERMS OF SERVICE

These terms are an agreement between you and Stackhouz Holdings LLC (“Curb Compass,” “we,” “us”), 2101 S. El Camino Real, STE 102, Oceanside, CA 92054, covering your use of curbcompass.com and app.curbcompass.com (the “Service”). By creating an account you agree to them.

  1. WHAT THE SERVICE IS

Curb Compass is a web application for real estate professionals who drive for dollars: it stores property leads, runs deal analysis, retrieves owner-contact information through third-party providers using your own API keys, and prints and mails postcards through your own Lob account. It is a tool for organizing and executing your own outreach — the leads, decisions, and outreach are yours.

  1. YOUR ACCOUNT

You must be 18 or older and provide accurate information. One account per person; you are responsible for activity under your login and for keeping your password secure. We may require email verification before enabling certain features.

  1. PLANS AND BILLING

Free plan: up to 15 leads with full deal analysis, up to 50 property photos, and skip-trace and value lookups with your own keys. No card required and no time limit.

Pro plan: $39 per month or $390 per year, billed through Stripe. Pro adds unlimited leads, direct-mail postcards with QR scan tracking, CSV exports, CRM webhooks, and 5 GB of photo storage.

Subscriptions renew automatically until canceled. You can cancel any time from the Billing page (handled through Stripe’s customer portal); your Pro features remain active through the end of the period you already paid for, and your account then continues on the free plan with your leads intact. Except where required by law, payments are not refunded or prorated. If we change prices, we will give you advance notice and the new price applies from your next renewal.

Charges from third-party providers you connect (RentCast, Tracerfy, Trestle, Lob) are billed to you directly by those providers at their own rates. We add no markup and are not responsible for their billing.

  1. YOUR KEYS AND THIRD-PARTY PROVIDERS

The Service is bring-your-own-key: value estimates, skip-traces, number verification, and postcard mailing run on provider accounts you own. You are responsible for keeping those accounts in good standing and for complying with each provider’s terms. Provider availability, pricing, data accuracy, and uptime are outside our control, and features that depend on a provider stop working if your key is invalid or your provider account is suspended or unfunded.

  1. ACCEPTABLE USE AND YOUR LEGAL RESPONSIBILITIES

You agree to use the Service only for lawful real estate prospecting. You are solely responsible for your outreach complying with all applicable laws, including the Telephone Consumer Protection Act (TCPA), federal and state Do-Not-Call rules, CAN-SPAM, and state solicitation laws. The Service flags numbers identified as litigation risks or on the federal Do-Not-Call registry and blocks in-app dialing to them, but these safeguards are an aid, not legal advice, and do not shift your compliance obligations to us.

Owner-contact data retrieved through the Service is not provided by a consumer reporting agency and may not be used for any purpose covered by the Fair Credit Reporting Act (FCRA), such as decisions about credit, employment, insurance, or housing eligibility.

You will not attempt to breach, probe, or overload the Service; scrape it; resell or share your account; upload unlawful content; or use the Service to harass anyone.

  1. YOUR CONTENT

You own the content you add — leads, notes, photos, voice notes, and pitches. You grant us a limited license to store, process, display, and transmit that content solely to operate the Service for you (for example, sending your postcard file to Lob for printing). You are responsible for having the rights to anything you upload.

  1. AI FEATURES

The Service includes optional AI assistance that drafts postcard pitch copy. AI-generated text can be inaccurate; review everything before you mail it. You are responsible for the final content of your outreach.

  1. OUR INTELLECTUAL PROPERTY

The Service, its software, design, and branding belong to Stackhouz Holdings LLC. We grant you a limited, non-exclusive, non-transferable license to use the Service under these terms. You may not copy, modify, reverse engineer, or create derivative works from it.

  1. COPYRIGHT COMPLAINTS (DMCA)

If you believe content on the Service infringes your copyright, send a notice to feedback@curbcompass.com or the mailing address above including: your contact information, identification of the copyrighted work and the allegedly infringing material, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you are authorized to act, and your physical or electronic signature. We will remove or disable access to material identified in valid notices and may terminate repeat infringers.

  1. DISCLAIMERS

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. Valuations, deal-analysis outputs, and owner-contact data are estimates and third-party records that may be wrong or out of date; they are not appraisals, legal advice, or investment advice. You make your own decisions.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Stackhouz Holdings LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost deals, or lost data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

  1. INDEMNIFICATION

You will indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your outreach activities, your violation of these terms, or your violation of any law or third-party right.

  1. TERMINATION

You can stop using the Service or delete your account at any time. We may suspend or terminate accounts that violate these terms, create legal risk, or abuse the Service, with notice where practical. Sections 5, 6, 8, 10, 11, 12, and 15 survive termination.

  1. CHANGES TO THESE TERMS

We may update these terms as the Service evolves. We will post the new version here with an updated date, and for material changes we will notify you by email or in the app. Continued use after changes take effect means you accept them.

  1. GOVERNING LAW

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.
